The Secretary of State, in exercise of the power conferred by section 2(2) of the Approved Premises (Substance Testing) Act 20221, makes the following Regulations.

Citation and extent

These Regulations may be cited as the Approved Premises (Substance Testing) Act 2022 (Commencement) Regulations 2022.

Commencement of Act3

The Approved Premises (Substance Testing) Act 2022 comes into force on 3rd October 2022.

EXPLANATORY NOTE

These Regulations commence the whole of the Approved Premises (Substance Testing) Act 2022.

The Approved Premises (Substance Testing) Act 2022 inserts a new section 13A (approved premises: substance testing) into the Offender Management Act 2007 (c. 21) to set out powers to substance and prevalence test residents of approved premises. Under these powers, residents can be required to provide a sample, which will be used to ascertain whether a resident has controlled drugs, prescription medicine, medicinal products, or psychoactive substances in their system.
