The Secretary of State for Education makes these Regulations in exercise of the powers conferred by sections 1(2), (3), (4) and (7), 2(1), (2), (4) and (5) and 4(2) of the Childcare Act 2016(1).

In accordance with section 2(3) of the Childcare Act 2016, these Regulations are made with the consent of the Treasury.
