Article 34W amended (notice to withhold allowances)7.

Article 34W is amended as follows.

After paragraph (1)(g) insert—
“(ga)
in relation to allowances that would otherwise have been allocated in respect of the installation for the 2023 scheme year, if the operator of the installation has made an application under Article 5a of the Activity Level Changes Regulation4 that has not been determined or has been granted an extension of time to make such an application that has not expired;”.

In paragraph (2) for “paragraph (1)(a) to (g)” substitute “paragraph (1)(a) to (ga)”
