The Air Traffic Management and Unmanned Aircraft Act 2021 (Commencement No. 2) Regulations 2022

The Secretary of State, in exercise of the powers conferred by section 21(3) and (4) of the Air Traffic Management and Unmanned Aircraft Act 20211, makes the following Regulations.

Citation and extent1

These Regulations may be cited as the Air Traffic Management and Unmanned Aircraft Act 2021 (Commencement No. 2) Regulations 2022.

These Regulations extend to England and Wales, Scotland and Northern Ireland.

Provisions coming into force on 18th February 20222

18th February 2022 is the day appointed for the coming into force of the following provisions of the Air Traffic Management and Unmanned Aircraft Act 2021—

a

section 1 (Meaning of “airspace change proposal”);

b

section 2 (Direction to progress airspace change proposal);

c

section 3 (Direction to co-operate in airspace change proposal);

d

section 4 (Directions under sections 2 and 3: supplemental);

e

section 5 (Delegation of functions to CAA);

f

section 6 (Provision of information);

g

section 7 (Appeals and enforcement), so far as not already in force;

h

section 8 (Part 1: interpretation);

i

Schedule 1 (Appeals against decisions to give or vary airspace change directions); and

j

Schedule 2 (Enforcement of airspace change directions and connected appeals), so far as not already in force.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring into force on 18th February 2022 Part 1 of the Air Traffic Management and Unmanned Aircraft Act 2021 (c. 12) (“the Act”), insofar as it is not already in force by virtue of section 21 (commencement) of the Act.

These are the second set of commencement regulations made under the Act, and bring into force the last remaining provisions of the Act.

Part 1 of the Act concerns airspace change proposals and provides new powers for the Secretary of State (delegable to the Civil Aviation Authority) to direct air navigation service providers, airport operators and other persons with functions relating to air navigation to progress or cooperate in airspace change proposals. Section 21(1) of the Act brought section 7(2) and Schedule 2 into force on Royal Assent (29th April 2021), but only for the purpose of making regulations. Regulation 2 of these commencement regulations brings sections 1 to 8 and Schedules 1 and 2 of the Act into force for all other purposes on 18th February 2022.
