The Secretary of State makes these Regulations in exercise of the powers conferred by section 50 of, and paragraphs 1(1) and 2(2) of Schedule 4 to, the Environment Act 2021 (“the Act”)(1).

The Secretary of State has consulted in accordance with paragraph 8(1) of Schedule 4 to the Act and is satisfied as to the matters specified in paragraph 9(1) of that Schedule.

The Secretary of State has the consent of Welsh Ministers to make these Regulations in accordance with section 50(3) of the Act.

Citation, commencement, extent and application

1.—(1) These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) (Amendment) (England and Wales) Regulations 2022 and come into force on 1st January 2023.

(2) These Regulations extend to and apply in relation to England and Wales only.

Amendment of the Producer Responsibility Obligations (Packaging Waste) Regulations 2007

2.—(1) The Producer Responsibility Obligations (Packaging Waste) Regulations 2007(2) are amended as follows.

(2) In Schedule 2 (recycling obligations)—

(a)for paragraph 5 substitute—

5.  The percentage which is prescribed as the recycling target “X” for the year 2023 is 77%;

(b)in paragraph 6—

(i)for “years” substitute “year”,

(ii)for Table 2 in paragraph 6 substitute—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (S.I. 2007/871). Those Regulations impose on producers obligations to recycle packaging waste in order to attain overall recycling and material-specific recycling targets.

These Regulations set an overall recycling target as well as material-specific recycling targets for 2023 on obligated producers in England and Wales in relation to glass, plastic, aluminium, steel, paper/board and wood.
