Subject to paragraph (2), this Part applies to—
a
seagoing ships registered in the United Kingdom, wherever they may be; and
b
other seagoing ships while in United Kingdom waters.

This Part does not apply to—
a
ships of war and naval auxiliary ships;
b
ships owned or operated by a State and engaged only on governmental non-commercial service;
c
fishing vessels;
d
pleasure vessels; or
e
vessels referred to in regulation 5(3) of the Merchant Shipping (Vessels in Commercial Use for Sport or Pleasure) Regulations 199831 (small vessels).

In this Part, “ship” includes hovercraft.
