Interpretation of Part 2: general2

In this Part—

  • the 2016 Regulations” means the Environmental Permitting (England and Wales) Regulations 20162;

  • the Batteries Directive” means Directive 2006/66/EC of the European Parliament and of the Council on batteries and accumulators and waste batteries and accumulators3;

  • the End-of-Life Vehicles Directive” means Directive 2000/53/EC of the European Parliament and of the Council on end-of life vehicles4;

  • the Landfill Directive” means Council Directive 1999/31/EC on the landfill of waste5;

  • the Mining Waste Directive” means Directive 2006/21/EC of the European Parliament and of the Council on the management of waste from extractive industries6;

  • the Waste Framework Directive” means Directive 2008/98/EC of the European Parliament and of the Council on waste7;

  • the WEEE Directive” means Directive 2012/19/EU of the European Parliament and of the Council on waste electrical and electronic equipment (WEEE)8.

Meaning of appropriate authority3

In this Part, “appropriate authority” has the meaning given by this regulation.

The “appropriate authority” is—

a

for regulations applying in relation to England, the Secretary of State;

b

for regulations applying in relation to Wales, the Welsh Ministers;

c

for regulations applying in relation to Scotland, the Scottish Ministers;

d

for regulations applying in relation to Northern Ireland, the Department of Agriculture, Environment and Rural Affairs.

But the appropriate authority is the Secretary of State if consent is given by—

a

the Welsh Ministers for regulations applying in relation to Wales;

b

the Scottish Ministers for regulations applying in relation to Scotland;

c

the Department of Agriculture, Environment and Rural Affairs for regulations applying in relation to Northern Ireland.

Meaning of “appropriate agency”4

In this Part, “appropriate agency” means—

a

for regulations applying in relation to England, the Environment Agency;

b

for regulations applying in relation to Wales, the Natural Resources Body for Wales;

c

for regulations applying in relation to Scotland, the Scottish Environment Protection Agency.
