Appointment and tenure of office3

The Commissioner is to be appointed for a term of three years.

A person who has held office as the Commissioner is eligible for re-appointment for a second term.

A person who has held office as the Commissioner for two terms is ineligible for reappointment at any time.

The Commissioner may at any time resign by notice in writing to the Secretary of State.

The Secretary of State may remove the Commissioner from office, by notice in writing, if the Secretary of State is satisfied that the Commissioner has—

a

become unfit or unable properly to discharge the functions of the Commissioner; or

b

behaved in a way that is not compatible with continuing in office.
