The Secretary of State, in exercise of the powers conferred by Article 4(3) of Regulation (EC) No 300/2008 of the European Parliament and of the Council of 11 March 2008 on common rules in the field of civil aviation security(1), makes the following Regulations:

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Aviation Security (Amendment) Regulations 2022.

(2) Subject to paragraph (3), these Regulations come into force on 30th April 2022.

(3) Paragraphs (2), (5) and (6) of regulation 2 come into force on 20th May 2022.

(4) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Amendment of Commission Implementing Regulation (EU) 2015/1998

2.—(1) The Annex to Commission Implementing Regulation (EU) 2015/1998 of 5 November 2015 laying down detailed measures for the implementation of the common basic standards on aviation security(2) is amended as follows.

(2) For point 1.4.3.2 substitute—

1.4.3.2 Explosive trace detection (ETD) equipment may only be used as a supplementary means of examination..

(3) Omit the first sentence of point 11.1.5.

(4) In point 11.5.1, in paragraph (a), for the words “points 11.1.3 and 11.1.5” substitute “point 11.1.3”.

(5) In point 12.8, for the heading substitute “Evaluating methods of screening”.

(6) In point 12.8.1—

(a)for the words “using new technologies other than those laid down in”, substitute “notwithstanding any limitations imposed by”; and

(b)in paragraph (a), for “a new” substitute “that”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make amendments to legislation in the field of aviation security.

Regulation 2 amends Commission Implementing Regulation (EU) 2015/1998 (aviation security). In particular, the amendments remove the requirement in retained EU law that explosive detection dogs may only be used as a supplementary means of examination of vehicles and permit the use of existing technologies for the purpose of evaluating their use as alternative methods of screening. The amendments also remove from retained EU law the requirement that background or pre-employment checks be completed before beginning security training involving non-publicly available information.

A full impact assessment has not been produced for this instrument as no, or no significant impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum has been published alongside these Regulations on www.legislation.gov.uk.
