These Regulations may be cited as the Independent School Standards and Non-Maintained Special Schools (England) (Amendment) Regulations 2022 and come into force on 5th September 2022.

These Regulations extend to England and Wales.
Amendments to the Education (Independent School Standards) Regulations 20142

The Education (Independent School Standards) Regulations 20143 are amended as follows.

In regulation 2(1) (interpretation)—
a
in the definition of “the National Minimum Standards for Boarding Schools”4, for “April 2015” substitute “May 2022”
; and
b
in the definition of “the National Minimum Standards for Residential Special Schools”, for “April 2015” substitute “May 2022”
.

for “Standard 14” where it first occurs substitute “Standard 19”
; and

Transitional provisions4

Where after the coming into force of these Regulations, the Secretary of State makes a decision specified in the left-hand column of the following table in the circumstances specified in the right-hand column, that decision is to be taken as if the amendments made by these Regulations had not been made.

Where an inspection of a description specified in the left-hand column of the following table is carried out in the circumstances specified in the right-hand column, that inspection is to be carried out, and the report of that inspection made, as though the amendments made by these Regulations had not been made.
