Explanatory Note

(This note is not part of the Regulations)

These Regulations bring into force specified provisions of the Health and Care Act 2022 (c. 31) (“the Act”) on 1st October 2023. They are the seventh set of commencement regulations to be made under the Act.

Regulation 2 commences provisions which establish the Health Services Safety Investigations Body and certain provisions in relation to medical examiners. Section 169(5) of the Act has not been commenced because it amends a definition which is yet to be inserted into section 41(1) of the Births and Deaths Registration Act 1953 (c. 20); that insertion will be made once the relevant part of paragraph 21(1) of Schedule 21 to the Coroners and Justice Act 2009 (c. 25) is commenced.
