The Secretary of State makes these Regulations in exercise of the powers conferred by sections 182 and 183(1) of the Health and Care Act 2022(1).

PART 1Introductory

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Health and Care Act 2022 (Further Consequential Amendments) (No. 2) Regulations 2023 and come into force on 6th November 2023.

(2) Any amendment or revocation made by the provisions in Parts 2 and 3 has the same extent as the provision amended or revoked.

PART 2Provisions relating to the National Health Service Commissioning Board being renamed NHS England

Amendment of the Income Support (General) Regulations 1987

2.—(1) The Income Support (General) Regulations 1987(2) are amended as follows.

(2) In Schedule 9, in paragraph 27(db) for “the National Health Service Commissioning Board” substitute “NHS England”.

Amendment of the National Health Service Pension Scheme Regulations 1995

3.—(1) The National Health Service Pension Scheme Regulations 1995(3) are amended as follows.

(2) In regulation A2, in the definition of “type 2 dental practitioner”, in paragraph (b) in the words before sub-paragraph (i)—

(a)for “the National Health Service Commissioning Board or” substitute “NHS England or the”;

(b)for “the Board” substitute “NHS England or the Local Health Board”.

(3) In regulation A3, in paragraph (1)(b)(vii)(bb) for “Board” substitute “NHS England or that Local Health Board”.

Amendment of the NHS Bodies and Local Authorities Partnership Arrangements Regulations 2000

5.—(1) The NHS Bodies and Local Authorities Partnership Arrangements Regulations 2000(5) are amended as follows.

(2) In regulation 2, in paragraph (1)—

(a)omit the definition of “the Board”;

(b)at the appropriate place insert—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make further amendments which are consequential on the Health and Care Act 2022 (“the 2022 Act”).

Part 2 makes amendments which are consequential on the National Health Service Commissioning Board being renamed to NHS England (see section 1 of the 2022 Act).

Part 3 makes amendments which are consequential on the establishment of integrated care boards and the abolition of clinical commissioning groups (see section 19 of the 2022 Act).
