Section 41 and section 9 are referred to below as “the statutory prohibitions”. Amendment of the Crown Court (Recording and Broadcasting) Order 2020 12 In article 2 of the Crown Court (Recording and Broadcasting) Order 2020, in the definition of “judge”, after paragraph (a) insert— aa an ex-officio or ordinary judge of the Court of Appeal within the meaning of section 2 of the Senior Courts Act 1981, or a Lord Justice of Appeal (England and Wales) (sitting in retirement); . S.I. 2020/637. 1981 c. 54. Relevant amendments were made by the Constitutional Reform Act 2005 (c. 4), sections 15, 145 and 146 and Schedule 4 paragraph 115, Schedule 17 paragraph 22 and Schedule 18 Part 2. See section 123 of and Schedule 3 to the Public Services Pensions and Judicial Offices Act 2022 (c. 7).
