The Secretary of State makes these Regulations in exercise of the powers conferred by sections 35(3) and (5)(a), 39(1), 43(1), 44 and 104(2) of the Childcare Act 2006(1).

In accordance with section 43(2) of the Childcare Act 2006, the Secretary of State has consulted His Majesty’s Chief Inspector of Education, Children’s Services and Skills and other appropriate persons.
