The Asylum Support (Amendment) Regulations 2023

The Secretary of State makes these Regulations in exercise of the powers in section 95(12) of, and paragraphs 1 and 3(a) of Schedule 8 to, the Immigration and Asylum Act 1999(1).

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Asylum Support (Amendment) Regulations 2023.

(2) These Regulations come into force on 15th January 2024.

(3) These Regulations extend to England and Wales, Scotland and Northern Ireland.

Amendments of the Asylum Support Regulations 2000

2.—(1) The Asylum Support Regulations 2000(2) are amended as follows.

(2) In regulation 10(2)(3) (kind and levels of support for essential living needs), for “£40.85” substitute “£49.18”.

(3) In regulation 10A(4) (additional support for pregnant women and children under 3)—

(a)in the heading, for “under 3” substitute “under 4”;

(b)in paragraph (1)—

(i)for “under 3” substitute “under 4” in each place in which it occurs;

(ii)in the table—

(aa)in rows 1 and 3, for “£3.00” substitute “£5.25”;

(bb)in row 2, for “£5.00” substitute “£9.50”.

Revocation of the Asylum Support (Amendment) Regulations 2022

3.  The Asylum Support (Amendment) Regulations 2022(5) are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

This instrument amends the Asylum Support Regulations 2000 (S.I. 2000/704) in the following ways. First, it increases the weekly cash payment made by the Secretary of State in respect of essential living needs of persons to whom the Secretary of State has decided to provide asylum support from £40.85 to £49.18. Secondly, it increases the additional weekly support for pregnant women and young children from £3.00 to £5.25 and for babies under 1 year old from £5.00 to £9.50. Thirdly, it extends the eligibility for additional weekly payments for young children to children aged 3 years old.

These regulations also revoke the Asylum Support (Amendment) Regulations 2022 (S.I. 2022/78), which set out the previous cash amounts payable.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
