Transitional and savings provisions4

Where a worker relied on regulation 13(10) and (11) of the 1998 Regulations to carry forward leave, that leave—

a

must be taken on or before 31st March 2024, and

b

may not be replaced by a payment in lieu except where the worker’s employment is terminated on or before that date, in which case the employer must make the worker a payment in lieu of leave equal to the sum due under regulation 16 of the 1998 Regulations for the period of untaken leave.
