1. In section 138(5) of the Local Government Act 1972 (powers of principal councils with respect to emergencies or disasters)(1), the reference to “metropolitan county fire and rescue authority” is to apply as if it included the Combined Authority as a fire and rescue authority.

Section 138 was amended by Part 1 of Schedule 34 to the Local Government, Planning and Land Act 1980 (c. 65), section 156 of the Local Government and Housing Act 1989 (c. 42), paragraph 22(2) of Schedule 1 to the Water Consolidation (Consequential Provisions) Act 1991 (c. 60), paragraphs 7 and 10 of Schedule 2 to the Civil Contingencies Act 2004 (c. 36) and paragraph 40 of Schedule 2 to the Policing and Crime Act 2017.
