Citation, commencement, extent and interpretation

1.—(1) These Regulations may be cited as the Education (Induction Arrangements for School Teachers) (England) (Amendment) Regulations 2023 and come into force on 1st September 2023.

(2) These Regulations extend to England and Wales.

(3) In these Regulations “the Induction Regulations” means the Education (Induction Arrangements for School Teachers) (England) Regulations 2012(2).

Amendment of the Education (Induction Arrangements for School Teachers) (England) Regulations 2012

2.—(1) Regulation 4(3) (appropriate body) of the Induction Regulations is amended as follows.

(2) In sub-paragraph (1)(c), omit “(b) or ”.

(3) In sub-paragraph (2)(a), at the end, insert “or”.

(4) Omit sub-paragraph (2)(b).

Saving provision

3.—(1) Notwithstanding the amendments to the Induction Regulations made by these Regulations, an authority may before 1st September 2024 act as an appropriate body in relation to an institution where—

(a)it was acting as an appropriate body in relation to that institution immediately before these Regulations came into force; and

(b)it is exercising its functions and powers as an appropriate body only in respect of a person who immediately before these Regulations came into force was serving an induction period at that institution.

(2) In this regulation “appropriate body”, “authority” and “institution” have the meanings given in regulation 3(1) of the Induction Regulations(4).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Education (Induction Arrangements for School Teachers) (England) Regulations 2012 (S.I. 2012/1115) to remove a local authority from the list of those able to act as an appropriate body under those Regulations from 1st September 2023. Regulation 3 of these Regulations provides that a local authority can continue to act as an appropriate body until 31st August 2024 where that local authority has already been appointed as an appropriate body in relation to a particular institution and for a person who immediately before these Regulations came into force was serving an induction period in that particular institution.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
