Amendments to the Criminal Procedure Rules

7.  In Part 9 (Allocation and sending for trial)—

(a)in rule 9.2 (Exercise of magistrates’ court’s powers)—

(i)for paragraph (4) substitute—

(4) The court may exercise its power to adjourn—

(a)if either party asks; or

(b)on its own initiative., and

(ii)omit the fifth paragraph of the note to the rule; and

(b)in rule 9.4 (Duty of justices’ legal adviser)—

(i)at the end of paragraph (2)(a) insert “and”,

(ii)at the end of paragraph (2)(b) omit “and”,

(iii)omit paragraphs (2)(c) and (3), and

(iv)at the end of the note to the rule insert “See also rule 2.12 (Duties of justices’ legal adviser).”.
