This Statutory Instrument makes corrections to regulation 8 of S.I. 2023/63 and is being issued free of charge to all known recipients of that Statutory Instrument.

The Secretary of State makes these Regulations in exercise of the powers conferred by section 2A(1)(a) of the Poisons Act 1972(1) (“the 1972 Act”).
In determining the distribution of substances as between the various Parts of Schedule 1A(2) to the 1972 Act, the Secretary of State has had regard to the desirability of restricting Parts 3 and 4 to substances that meet the criteria provided by section 2A(3) of that Act.
1.—(1) These Regulations may be cited as the Control of Explosives Precursors and Poisons (Amendment) Regulations 2023 and come into force on 1st October 2023.
(2) These Regulations extend to England and Wales and Scotland.
2. For regulation 8 of the Control of Explosives Precursors and Poisons Regulations 2023 (Amendments to Schedule 1A to the 1972 Act)(3) substitute—
8.—(1) Schedule 1A to the 1972 Act (regulated substances and reportable substances) is amended as follows.

These Regulations are being issued free of charge in order to make corrections to regulation 8 (“regulation 8”) of the Control of Explosives Precursors and Poisons Regulations 2023 (S.I. 2023/63) (“the Principal Regulations”).
Regulation 8 makes amendments to Schedule 1A to the Poisons Act 1972 (c. 66). Regulation 2 of these Regulations substitutes a new regulation 8 to include Chemical Abstracts Service Registry numbers for certain substances, and to make separate provision for Zinc phosphide and Calcium phosphide.
A full impact assessment of the effect that the Principal Regulations (including regulation 8) will have on the costs of business, the voluntary sector and the public sector was undertaken.
