PART 6FOR THE PROTECTION OF NATIONAL HIGHWAYS LIMITED
Defects Period
73.
(1)
In respect of any specified works approved under paragraph 67(2)—

The undertaker must at its own expense remedy any defects in the strategic road network as are reasonably required by National Highways to be remedied during the defects period. All identified defects must be remedied in accordance with the following timescales—
(a)
in respect of matters of urgency, within 24 hours of receiving notification for the same (urgency to be determined at the absolute discretion of National Highways);
(b)
in respect of matters which National Highways considers to be serious defects or faults, within 14 days of receiving notification of the same; and
(c)
in respect of all other defects notified to the undertaker, within 4 weeks of receiving notification of the same.
(3)
Following the expiry of the defects period National Highways has responsibility for routine maintenance of the strategic road network save for any soft landscaping works which must be established and which must thereafter be maintained for a period of 3 years by and at the expense of the undertaker.
