Part 2Commencement of provisions of the Planning Act 2008

Provisions of the 2008 Act coming into force on 25th April 2024

2.  The following provisions of the 2008 Act come into force on 25th April 2024—

(a)section 196 (determination of procedure for certain proceedings), and

(b)paragraphs 1, 7, 8 and 10 to 14 of Schedule 10 (further provisions as to the procedure for certain proceedings),

so far as they relate to any appeal under section 195 of the 1990 Act(1) (appeals against refusal or failure to give decision on application) against a refusal, or failure to give a decision, of a local planning authority.

Section 195 was amended by paragraph 32 of Schedule 7 to the Planning and Compensation Act 1991 (c. 34), paragraph 3 of Schedule 11 to the Planning Act 2008 (c. 29), paragraph 6 of Schedule 1 to the Town and Country Planning (Determination of Procedure) (Wales) Order 2014 (S.I. 2014/2773 (W. 280)) and section 47(2) and paragraph 7(3) of Schedule 7 to the Planning (Wales) Act 2015 (anaw/dccc 4).
