The Secretary of State makes these Regulations in exercise of the powers conferred by section 339ZL(5) of the Proceeds of Crime Act 2002 (“the 2002 Act”)(1) and by section 22F(5) of the Terrorism Act 2000 (“the 2000 Act”)(2).
In accordance with section 459(4)(azab) and (6ZBB) of the 2002 Act(3) and section 123(4)(aza) of the 2000 Act(4) a draft of this instrument has been laid before and approved by a resolution of each House of Parliament.
The Secretary of State has—
under section 339ZL(1) and (9) of the 2002 Act and section 22F(1) and (9) of the 2000 Act made a code of practice;
in accordance with section 339ZL(2), (3) and (4) of the 2002 Act and section 22F(2), (3) and (4) of the 2000 Act, published a draft of the code of practice, considered any representations made about the draft, modified the draft as the Secretary of State thought appropriate in the light of any such representations and laid the draft before Parliament.
1.—(1) These Regulations may be cited as the Proceeds of Crime Act 2002 and Terrorism Act 2000 (Certain Information Orders: Code of Practice) Regulations 2024 and come into force on 26th April 2024.
(2) These Regulations extend to the United Kingdom.
2. The code of practice entitled “Code of Practice issued under section 339ZL of the Proceeds of Crime Act 2002 and section 22F of the Terrorism Act 2000 about certain information orders” and laid before Parliament in draft on 22nd January 2024 comes into operation on 26th April 2024.

These Regulations bring into operation a new joint code of practice issued under the Proceeds of Crime Act 2002 (c. 29) (“the 2002 Act”) and the Terrorism Act 2000 (c. 11) (“the 2000 Act”).
This new code of practice is prepared by the Secretary of State in relation to powers exercisable by the Director General of the National Crime Agency or an authorised officer of the National Crime Agency in connection with the exercise of their functions under section 339ZH of the 2002 Act or section 22B(1A) of the 2000 Act, when making applications for certain information orders.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
2002 c. 29. Section 339ZL was inserted by section 185(12) of the Economic Crime and Corporate Transparency Act 2023 (c. 56).
2000 c. 11. Section 22F was inserted by section 186(13) of the Economic Crime and Corporate Transparency Act 2023.
Paragraph (azab) and subsection (6ZBB) were inserted by section 185(13) of the Economic Crime and Corporate Transparency Act 2023.
Paragraph (aza) was inserted by section 186(14) of the Economic Crime and Corporate Transparency Act 2023.
