Amendment of the Representation of the People (England and Wales) Regulations 20012

The Representation of the People (England and Wales) Regulations 20015 are amended as follows.

In regulation 3 (interpretation), in paragraph (1)—

a

after the definition of “previous residence condition” insert—

  • “qualifying Commonwealth citizen” has the same meaning as in section 4(6) of the 1983 Act6;

b

for the definition of “relevant EU applicant” substitute—

  • “relevant EU applicant” means an applicant—

    1. a

      who is a citizen of a member State, and

    2. b

      who is not, or is not also—

      1. i

        a citizen of a member State listed in Schedule 6A to the 1983 Act7,

      2. ii

        a qualifying Commonwealth citizen, or

      3. iii

        a citizen of the Republic of Ireland;
