2.—(1) In these Regulations, “the Act” means the Energy Act 2023.
(2) These Regulations only apply for the purposes of a carbon capture revenue support contract(1) entered into pursuant to a direction given by the Secretary of State under section 68(1) of the Act.
A “carbon capture revenue support contract” is defined by section 67(2) of the Act which for the purposes of these Regulations means a contract entered into by a carbon capture counterparty pursuant to a direction given by the Secretary of State under section 68(1).
