Part 1Subordinate Legislation

Food Supplements (England) Regulations 2003

1.  In regulation 5(2)(a) of the Food Supplements (England) Regulations 2003(1) for “retained direct EU” substitute “assimilated direct”.

Food for Particular Nutritional Uses (Addition of Substances for Specific Nutritional Purposes) (England) Regulations 2009

2.  In Schedule 1 to the Food for Particular Nutritional Uses (Addition of Substances for Specific Nutritional Purposes) (England) Regulations 2009(2), in the entries in the subject matter column that relate to Article 4(2) and Article 4(3), for “retained EU” substitute “assimilated”.

Regulation (EC) No 1924/2006

3.  In Article 19(2) of Regulation (EC) No 1924/2006 of the European Parliament and of the Council of 20 December 2006 on nutrition and health claims made on foods(3) for “retained direct EU” substitute “assimilated direct”.

Regulation (EU) No 609/2013

4.  Regulation EU No 609/2013 of the European Parliament and of the Council of 12 June 2013 on food intended for infants and young children, food for special medical purposes, and total diet replacement for weight control and repealing Council Directive 92/52/EEC, Commission Directives 96/8/EC, 1999/21/EC, 2006/125/EC and 2006/141/EC, Directive 2009/39/EC of the European Parliament and of the Council and Commission Regulations (EC) No 41/2009 and (EC) No 953/2009(4) is amended as follows—

(a)in Article 6(1) and (2) for “retained EU” substitute “assimilated”;

(b)in Article 15(4) and (5) for “retained EU” substitute “assimilated”.
