Darpariaethau trosiannol
13.—(1) Mewn unrhyw achos am dramgwydd —
(a)o dan reoliad 7(a), neu
(b)o dan reoliad 7(b), fel y'i darllenir gyda rheoliad 5 neu 6,
mewn perthynas â'r manylion y mae Rheoliad 1139/98 yn ei gwneud yn ofynnol eu marcio neu eu labelu ar unrhyw fwyd perthnasol, bydd yn amddiffyniad profi —
(i)yn achos bwyd a werthwyd i'r prynwr terfynol, ei fod wedi'i baratoi gan ddefnyddio cynhwysyn a oedd ar werth cyn 1 Medi 1998, neu
(ii)yn achos bwyd a werthwyd i fasarlwyydd, ei fod wedi'i baratoi gan ddefnyddio cynhwysyn a oedd ar werth cyn 10 Ebrill 2000.
(2) Mewn unrhyw achos am dramgwydd —
(a)o dan reoliad 7(a), neu
(b)o dan reoliad 7(b), fel y'i darllenir gyda rheoliad 5 neu 6,
mewn perthynas â'r manylion y mae Rheoliad 50/2000 yn ei gwneud yn ofynnol eu marcio neu eu labelu ar unrhyw fwyd perthnasol , bydd yn amddiffyniad profi bod y bwyd wedi'i werthu i'r prynwr terfynol neu i fasarlwyydd a'i fod wedi'i baratoi gan ddefnyddio cynhwysyn a oedd ar werth cyn 10 Ebrill 2000.
(3) At ddibenion paragraffau (1) a (2) uchod, ystyr “bwyd perthnasol” yw bwyd —
(i)nad yw wedi'i ragbacio, neu
(ii)sydd wedi'i ragbacio i'w werthu'n uniongyrchol.
