Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. (Nid yw'r nodyn hwn yn rhan o'r Rheoliadau)
Mae Rhan III o Ddeddf Llywodraeth Leol 2000 (“y Ddeddf”) yn gwneud darpariaeth i gynghorau sir a chynghorau bwrdeistref sirol, cynghorau cymuned, awdurdodau tân, awdurdodau heddlu ac awdurdodau Parciau Cenedlaethol yng Nghymru (“awdurdodau perthnasol”) fabwysiadu cod ymddygiad i aelodau ac aelodau cyfetholedig ac i Gomisiynydd Lleol yng Nghymru ymchwilio i achosion lle yr honnir bod aelod neu aelod cyfetholedig (neu gyn-aelod neu gyn-aelod cyfetholedig) o awdurdod perthnasol wedi methu â chydymffurfio â chod ymddygiad yr awdurdod, neu ei bod yn bosibl eu bod wedi methu â chydymffurfio ag ef.
Yn dilyn ymchwiliad o'r fath, caiff Comisiynydd Lleol yng Nghymru benderfynu y dylai'r materion sy'n destun yr ymchwiliad gael eu cyfeirio at lywydd Panel Dyfarnu Cymru er mwyn i dribiwnlys sy'n dod o fewn adran 76(1) o'r Ddeddf (“tribiwnlys achos”) ddyfarnu arnynt.
O dan amgylchiadau penodol, cyn i ymchwiliad gael ei gwblhau, caiff Comisiynydd Lleol yng Nghymru gynhyrchu adroddiad interim a chyfeirio'r materion sy'n destun yr adroddiad at lywydd Panel Dyfarnu Cymru er mwyn i dribiwnlys sy'n dod o fewn adran 76(2) o'r Ddeddf (“tribiwnlys achos interim”) ddyfarnu arnynt.
Mae'r rheoliadau hyn, sy'n cael eu gwneud o dan adran 77(4) a (6) o'r Ddeddf, yn gwneud darpariaeth mewn perthynas â dyfarniadau gan dribiwnlysoedd achos a thribiwnlysoedd achos interim.
