Dosbarthu parthau
5.—(1) Rhaid i'r Cynulliad Cenedlaethol ddosbarthu pob parth mewn perthynas â phob un o'r llygrynnau perthnasol yn ôl a yw'n ofynnol asesu ansawdd yr aer amgylchynol yn y parth hwnnw ar gyfer y llygryn hwnnw —
(a)drwy fesuriadau;
(b)drwy gyfuniad o fesuriadau a thechnegau modelu; neu
(c)drwy ddefnyddio technegau modelu neu dechnegau amcangyfrif gwrthrychol yn unig.
(2) Rhaid i fesuriadau gael eu defnyddio i asesu ansawdd yr aer amgylchynol mewn perthynas â llygryn perthnasol mewn parth —
(a)os yw'r parth yn grynhoad;
(b)os yw lefelau'r llygryn yn y parth rhwng y gwerthoedd terfyn perthnasol a'r trothwyon asesu uchaf; neu
(c)os yw lefelau'r llygryn hwnnw yn y parth yn uwch na gwerthoedd terfyn y llygryn hwnnw.
(3) Gellir defnyddio cyfuniad o fesuriadau a thechnegau modelu i asesu ansawdd yr aer amgylchynol mewn unrhyw barth mewn perthynas â llygryn perthnasol os yw lefelau'r llygryn dros gyfnod cynrychioliadol yn is na'r trothwyon asesu uchaf perthnasol.
(4) Os yw lefelau llygryn perthnasol mewn unrhyw barth yn is na'r trothwyon asesu isaf perthnasol, caniateir defnyddio technegau modelu neu dechnegau amcangyfrif gwrthrychol yn unig i asesu lefelau'r llygryn hwnnw oni bai —
(a)mai crynhoad yw'r parth; a
(b)mai sulphur dioxide neu nitrogen dioxide yw'r llygryn sy'n cael ei asesu.
(5) Penderfynir ar y trothwyon asesu uchaf ac isaf ar gyfer y llygrynnau perthnasol yn unol ag Atodlen 2.
(6) Os oes parth wedi'i ddosbarthu mewn perthynas â llygryn o dan baragraff (1)(a), gellir defnyddio technegau modelu i gydategu'r mesuriadau a gymerir er mwyn rhoi lefel ddigonol o wybodaeth am ansawdd yr aer amgylchynol mewn perthynas â llygryn perthnasol mewn parth.
(7) Rhaid i'r dosbarthiad parthau y mae paragraff (1) yn gofyn amdano gynnwys unrhyw barthau y gall y Cynulliad Cenedlaethol eu dosbarthu fel rhai sy'n uwch na'r gwerthoedd terfyn ar gyfer —
(a)sulphur dioxide oherwydd crynodiadau sulphur dioxide yn yr aer amgylchynol oherwydd ffynonellau naturiol;
(b)PM10 oherwydd crynodiadau o PM10 yn yr aer amgylchynol oherwydd —
(i)digwyddiadau naturiol sy'n arwain at grynodiadau sy'n sylweddol uwch na'r lefelau cefndir arferol o ffynonellau naturiol; neu
(ii)ail-ddal gronynnau ar ôl i ffyrdd gael eu trin â thywod yn y gaeaf.
