Mae Cynulliad Cenedlaethol Cymru yn gwneud y Gorchymyn canlynol drwy arfer y pwerau a roddwyd i'r Ysgrifennydd Gwladol gan adrannau 83(1) a (4) o Ddeddf Llywodraeth Leol 1972(1) ac adran 26(3) o Ddeddf yr Iaith Gymraeg 1993(2) a freiniwyd yng Nghynulliad Cenedlaethol Cymru bellach i'r graddau y maent yn arferadwy yng Nghymru(3) a thrwy arfer y pwerau a roddwyd i Gynulliad Cenedlaethol Cymru gan adran 52(2) o Ddeddf Llywodraeth Leol 2000(4)).
1.—(1) Enw'r Gorchymyn hwn yw Gorchymyn Etholiadau Lleol (Datganiad Derbyn Swydd) (Diwygio) (Cymru) 2001 a daw i rym ar 24 Awst 2001.
(2) Mae'r Gorchymyn hwn yn gymwys i bob awdurdod yng Nghymru
2. Yn y Gorchymyn hwn—
ystyr “awdurdod” yw—
cyngor sir,
cyngor bwrdeistref sirol, ac
cyngor cymuned;
ystyr “y Gorchymyn Cymunedau” yw Gorchymyn Etholiadau Lleol (Plwyfi a Chymunedau) (Datganiad Derbyn Swydd) 1990(5);
ystyr “y Gorchymyn Prif Gynghorau” yw Gorchymyn Etholiadau Lleol (Prif Ardaloedd) (Datganiad Derbyn Swydd) 1990(6);
ystyr “y Gorchymyn Ffurflenni Cymraeg” yw Gorchymyn Etholiadau Lleol (Datganiad Derbyn Swydd) (Ffurflenni Cymraeg) 1991(7).
3.—(1) Mae'r Gorchymyn Cymunedau'n cael ei ddiwygio yn unol â'r paragraffau canlynol yn yr Erthygl hon.
(2) Ar ôl Erthygl 1, yn lle “Form of declaration of acceptance of office”, rhowch “Forms of declaration of acceptance of office”.
(3) Yn lle Erthygl 2, rhowch—
“2.—(1) The declaration of acceptance of office by the chairman or a councillor of a community council which has not at the time of declaration adopted a code as regards the conduct which is expected of its members and co-opted members under section 51 of the Local Government Act 2000 for the first time shall be in the form in Schedule 1 to this Order, or a form to the like effect.
(2) The declaration of acceptance of office by the chairman or a councillor of a community council which has at the time of declaration adopted a code as regards the conduct which is expected of its members and co-opted members under section 51 of the Local Government Act 2000 shall be in the form in Schedule 2 to this Order, or a form to the like effect.”.

(5) Ar ôl Atodlen 1, rhowch—

4.—(1) Mae'r Gorchymyn Prif Gynghorau'n cael ei ddiwygio yn unol â'r paragraffau canlynol yn yr Erthygl hon.
(2) Ar ôl Erthygl 1, yn lle “Form of declaration of acceptance of office”, rhowch “Forms of declaration of acceptance of office”.
(3) Yn lle Erthygl 2, rhowch—

5.—(1) Mae'r Gorchymyn Ffurflenni Cymraeg yn cael ei ddiwygio yn unol â'r paragraffau canlynol yn yr Erthygl hon.
(2) Yn lle Erthygl 2, rhowch—

(2) The declaration of acceptance of office by the chairman, vice-chairman, councillor or elected mayor of the council of a county or county borough which has at the time of declaration adopted a code as regards the conduct which is expected of its members and co-opted members under section 51 of the Local Government Act 2000 may be in the form in Schedule IA to this Order, or a form to the like effect, in place of the declaration of acceptance of office set out in Schedule 2 to the Local Elections (Principal Areas) (Declaration of Acceptance of Office) Order 1990.”.
(3) Yn lle Erthygl 3, rhowch—
“3.—(1) The declaration of acceptance of office by the chairman or a councillor of a community council which has not at the time of declaration adopted a code as regards the conduct which is expected of its members and co-opted members under section 51 of the Local Government Act 2000 for the first time may be in the form in Schedule II to this Order, or a form to the like effect, in place of the declaration of acceptance of office set out in Schedule 1 to the Local Elections (Parishes and Communities) (Declaration of Acceptance of Office) Order 1990.
(2) The declaration of acceptance of office by the chairman or a councillor of a community council which has at the time of declaration adopted a code as regards the conduct which is expected of its members and co-opted members under section 51 of the Local Government Act 2000 may be in the form in Schedule IIA to this Order, or a form to the like effect, in place of the declaration of acceptance of office set out in Schedule 2 to the Local Elections (Parishes and Communities) (Declaration of Acceptance of Office) Order 1990.”.

Mae Adran 83(1) o Ddeddf Llywodraeth Leol 1972 (“Deddf 1972”) yn gwahardd person sydd wedi'i ethol i swydd cadeirydd, is-gadeirydd, cynghorydd neu faer etholedig cyngor sir neu gyngor bwrdeistref sirol yng Nghymru rhag gweithredu mewn swydd o'r fath oni bai fod y person hwnnw wedi gwneud datganiad ei fod yn derbyn y swydd yn y ffurf a ragnodir gan orchymyn a bod y datganiad hwnnw yn cael ei draddodi i'r swyddog priodol yn y cyngor o fewn dau fis o ddyddiad yr etholiad. Os na chaiff datganiad o'r fath ei wneud a'i draddodi i'r swyddog priodol o fewn yr amser a bennwyd, bydd swydd y person hwnnw yn dod yn wag.
O dan adran 83(4) o Ddeddf 1972, bydd swydd person a etholir i swydd cadeirydd cyngor cymuned neu gynghorydd cymuned yn dod yn wag oni bai fod y person hwnnw yn gwneud datganiad ei fod yn derbyn y swydd yn y ffurf a ragnodir gan orchymyn ar yr adeg briodol yng ngŵ ydd personau priodol ac yn ei drosglwyddo i'r cyngor.
Mae Rhan III o Ddeddf Llywodraeth Cymru 2000 (“Deddf 2000”) yn sefydlu fframwaith moesegol newydd ar gyfer llywodraeth leol yng Nghymru. Mae Adran 51 o Ddeddf 2000 yn ei gwneud yn ofynnol i gynghorau sir, cynghorau bwrdeistref sirol a chynghorau cymuned (ymysg eraill) fabwysiadu cod ynghylch yr ymddygiad a ddisgwylir oddi wrth aelodau ac aelodau cyfetholedig y cynghorau hynny.
Mae adran 52 o Ddeddf 2000 yn ymwneud â'r ddyletswydd sydd ar aelodau ac aelodau cyfetholedig cynghorau sir, cynghorau bwrdeistref sirol a chynghorau cymuned i gydymffurfio â'r cod ymddygiad a fabwysiadwyd gan eu cynghorau o dan adran 51 o Ddeddf 2000.
Mae Adran 52(2) o Ddeddf 2000 yn darparu y gall ffurf datganiad derbyn swydd y gellir ei rhagnodi gan orchymyn o dan adran 83 o Ddeddf 1972 gynnwys ymrwymiad gan y sawl sy'n gwneud datganiad y byddant, wrth gyflwani eu swyddogaethau, yn parchu cod ymddygiad y cyngor sir, y cyngor bwrdeistref sirol neu'r cyngor cymuned perthnasol am y tro o dan adran 51 o Ddeddf 2000.
Mae'r Gorchymyn hwn yn diwygio tri gorchymyn sydd mewn grym o dan adran 83 o Ddeddf 1972 fel y bydd y sawl sy'n gwneud datganiad, pan fo cyngor sir, cyngor bwrdeistref sirol neu gyngor cymuned wedi mabwysiadu cod ymddygiad o dan adran 51 o Ddeddf 2000, yn ymrwymo y byddant wrth gyflawni eu swyddogaethau yn parchu cod ymddygiad y cyngor sydd am y tro yn bodoli o dan yr adran honno.
