Mae adran 313 o Ddeddf Addysg 1996 yn ei gwneud yn ofynnol i'r Ysgrifennydd Gwladol gyhoeddi Cod Ymarfer sy'n rhoi canllawiau ymarferol ynghylch sut y dylai awdurdodau addysg lleol a chyrff llywodraethu ysgolion a gynhelir gyflawni eu swyddogaethau o dan y Ddeddf honno mewn perthynas ag anghenion addysgol arbennig, ac yn caniatáu iddo ddiwygio'r Cod o dro i dro. Mae pwerau'r Ysgrifennydd Gwladol wedi'u trosglwyddo i'r Cynulliad Cenedlaethol mewn perthynas â Chymru. Mae'r Cynulliad Cenedlaethol wedi cyhoeddi Cod o dan y teitl Cod Ymarfer Anghenion Addysgol Arbennig Cymru. Mae'r Gorchymyn hwn yn penodi 1 Ebrill 2002 yn ddyddiad i'r Cod ddod i rym.
Gellir cael copïau o'r Cod oddi wrth Gynulliad Cenedlaethol Cymru, Parc Cathays, Caerdydd CF10 3NQ. Gellir ei gael ar y Rhyngrwyd hefyd yn www.cymru.gov.uk
Mae'r Cod, mewn perthynas â Chymru, yn disodli Rhestr Argymhellion gynharach a gyhoeddwyd gan Ysgrifennydd Gwladol Cymru a'r Ysgrifennydd Gwladol dros Addysg ar y cyd, ar 25 Mai 1994.
