Notwithstanding the amendments made to the principal Regulations by the provisions of the regulations listed in paragraph (2) (“the listed amendments”), where by virtue of regulation 6(3) of the Abolition of the Tribunal Regulations a case continues before the Tribunal after 31st July 2002, the listed amendments shall not apply to an ophthalmic medical practitioner or optician in relation to the ophthalmic medical practitioner’s or optician’s case until such time as the case has been concluded and the time for making an appeal has ended, or any appeal has been withdrawn, or the ophthalmic medical practitioner or optician has exhausted his or her rights of appeal, as the case may be.
