SHELLFISH

The Shellfish (Specification of Crustaceans) (Wales) Regulations 2002

The National Assembly for Wales, in exercise of the powers conferred on it by section 1(1) of the Sea Fisheries (Shellfish) Act 1967(1) and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Title, commencement and application

1.—(1) These Regulations are called the Shellfish (Specification of Crustaceans) (Wales) Regulations 2002 and come into force on 5th August 2002.

(2) These Regulations apply to Wales and the sea adjacent to Wales out as far as the seaward boundary of the territorial sea.

Specification of crustaceans

2.  Crabs are hereby specified for the purposes of section 1(1) of the Sea Fisheries (Shellfish) Act 1967.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which apply only in relation to Wales, add crabs to the types of shellfish falling within section 1(1) of the Sea Fisheries (Shellfish) Act 1967 (“the 1967 Act”). This enables several or regulated fisheries for crabs to be established by orders under that section.

Scallops and queens were specified for the purpose of section 1 of the 1967 Act by the Shellfish (Specification of Molluscs) Regulations 1987 (S.I. 1987/218).

1967 c. 83; relevant amendments to section 1(1) were made by the Sea Fisheries Act 1968 (c. 77) section 15(2), by the Fishery Limits Act 1976 (c. 86) Schedule 2, paragraph 15, by the Sea Fisheries (Shellfish) (Amendment) Act 1997 (c. 3) section 1, and by the Scotland Act 1998 (Consequential Modifications) (No. 2) Order 1999 (S.I. 1999/1820) Schedule 2, paragraph 42(2). The functions of “the appropriate Minister” in relation to Wales were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), Article 2 and Schedule 1.
