Regulation 38
11. In paragraph (3A)(1) of regulation 38 (notional capital) after sub-paragraph (b)(ii) insert—
“(iia)in the Intensive Activity Period specified in regulation 75(1)(a)(iv) of those Regulations or in the Intensive Activity Period for 50 plus;”.
