The National Assembly for Wales, in exercise of the powers conferred upon it by sections 2(2) and (4) and 146(1) and (2) of the Housing Grants, Construction and Regeneration Act 1996(1) as extended by section 26(3) of the Welsh Language Act 1993(2) makes the following Regulations:

Name, commencement and application

1.—(1) These Regulations are called the Housing Renewal Grants (Prescribed Forms and Particulars) (Amendment) (Wales) Regulations 2002 and shall come into force on 13th November 2002.

(2) These Regulations apply to Wales only, and shall not have effect in relation to applications for grant made before the date on which these Regulations come into force.

Amendments

2.—(1) The (English language) form set out in the Schedule to the Housing Renewal Grants (Prescribed Form and Particulars) Regulations 1996(3) is amended as set out in the English language text of the Schedule to these Regulations.

(2) The (Welsh language) form set out in the Schedule to the Housing Renewal Grants (Prescribed Form and Particulars) (Welsh Form and Particulars) Regulations 1998(4) is amended as set out in the Welsh language text of the Schedule to these Regulations.

Regulation 2

SCHEDULE

1.  At the end of question 3.1, add—

  • or are both of you receiving (and entitled to receive) a joint-claim jobseeker’s allowance?.

2.  In question 3.29 insert the following entries in the appropriate place—

3.  After question 3.34B, insert—

3.34C  Please give details of any payment made to you or your partner to compensate for events which occurred during the Second World War. Note 90F.

4.  In paragraphs (a) and (b) of the Authorisation at the end of Part 3 of the form, after “an income-based jobseeker’s allowance” insert “or a joint-claim jobseeker’s allowance”.

5.  In note 48—

(a)after “replaced income support” add “Where both partners qualify for the jobseeker’s allowance from 19th March 2001 they should make a “joint claim” for jobseeker’s allowance.”;

(b)After “Part 3”, in the second place where it occurs, insert “Where a couple are receiving a joint-claim jobseeker’s allowance, both members of the couple may complete the authorisation at the end of Part 3.”.

6.  In the list in the first paragraph of note 83 for “or in the Environment Task Force Option of the New Deal where you are self-employed under the Employment Option of the New Deal made under section 2 of the Employment and Training Act 1973;” substitute “, Environment Task Force Option of the New Deal where you are self-employed under the Employment Option of the New Deal, the Intensive Activity Period programme or the Intensive Activity Period for 50 plus made under section 2 of the employment and Training Act 1973 or as assistance to support your self-employment”.

7.  After note 84B insert—

84C.  Please give the details of any bereavement allowance which you have received in the last 12 months. A bereavement allowance is paid to a person aged over 55 years and under 60 who has been widowed on or after 9th April 2001. The allowance is paid under section 39B of the Social Security Contributions and Benefits Act 1992..

84D.  A widowed mother’s allowance is paid under section 37 of the Social Security Contributions and Benefits Act 1992 and a widowed parent’s allowance is paid under section 39A of that Act..

8.  After note 90E, insert—

90F.  The payments which are disregarded in the calculation of capital are those payable to you or your partner to compensate you, your partner, your deceased spouse or your partner’s deceased spouse for having been, during the Second World War, a slave labourer or forced labourer or the parent of a child who has died or for having suffered personal injury or loss of property during that War..

9.  At the end of note 93, add:

You should answer “No” to this question when you are on maternity leave, entitled to statutory maternity pay under section 164 of the Social Security Contributions and Benefits Act 1992 or maternity allowance under section 35 of that Act, and the childcare payments are only paid for the child to whom the maternity leave relates.”.

10.  In note 95A after “Part 3” insert “Where a couple are receiving joint-claim jobseeker’s allowance, both members of the couple may complete the authorisation at the end of Part 3.”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the (bilingual) Forms to be used by owner-occupiers and tenants when applying for housing renewal grants under Chapter I of Part I of the Housing Grants, Construction and Regeneration Act 1996.

The Welsh language form amended is set out in the Schedule to the Housing Renewal Grants (Prescribed Form and Particulars) (Welsh Form and Particulars) Regulations 1998 (S.I. 1998/1113 as amended).

The English language form amended is set out in the Schedule to the Housing Renewal Grants (Amendment) Regulations 1996 (S.I. 1996/2891 as amended).

The amendments are consequential on those being made by the Housing Renewal Grants (Amendment) (Wales) Regulations 2002 (S.I. 2799) (W.266)to the Housing Renewal Grants Regulations 1996 (S.I. 1996/2890).
