Gweithgareddau esempt

16.—(1) Yr achosion a'r amgylchiadau a ragnodwyd at ddibenion adrannau 108(7) a 111(7) o'r Ddeddf lle mae personau yn esempt rhag gofynion adran 108(1)(a) o'r Ddeddf (i gynnal asesiad risg) ac adran 111(1)(a) o'r Ddeddf (i sicrhau caniatâd), yn ôl eu trefn, i'r graddau y maent yn ymwneud â marchnata organeddau a addaswyd yn enetig yw'r holl achosion ac amgylchiadau—

(a)lle mae cynnyrch a gymeradwywyd yn cael ei farchnata at ddefnydd y mae wedi'i gymeradwyo ar ei gyfer;

(b)lle mae micro-organeddau a addaswyd yn enetig wedi'u rhoi ar gael ar gyfer gweithgareddau a reoleiddir o dan y Gyfarwyddeb Defnydd Amgaeëdig;

(c)lle mae organeddau a addaswyd yn enetig ac eithrio micro-organeddau sy'n dod o dan baragraff (b) wedi'u rhoi ar gael i'w defnyddio'n unig ar gyfer gweithgareddau lle mae mesurau amgáu llym priodol yn seiliedig ar yr un egwyddorion o amgáu â'r rhai a bennir yn y Gyfarwyddeb Defnydd Amgaeëdig er mwyn cyfyngu ar y cysylltiad rhyngddynt â'r boblogaeth yn gyffredinol a'r amgylchedd a sicrhau lefel uchel o ddiogelwch iddynt;

(ch)lle mae organeddau a addaswyd yn enetig wedi'u rhoi ar gael i'w defnyddio'n unig ar gyfer gollyngiadau bwriadol sy'n cydymffurfio â'r gofynion a nodwyd yn Rhan II;

(d)lle mae organedd a addaswyd yn enetig ac a awdurdodwyd o dan Reoliad y Cyngor (EEC) Rhif 2309/93(1), fel y'i diwygiwyd gan Reoliad y Comisiwn EC Rhif 649/98(2), yn cael ei farchnata; neu

(dd)lle mae bwyd newydd neu gynhwysyn bwyd newydd o fewn cwmpas Rheoliad EC Rhif 258/97 Senedd a Chyngor Ewrop(3) yn cael ei farchnata yn unol â'r Rheoliad hwnnw.
