Cosbau: methu â chydymffurfio â gofynion i hysbysu
14.—(1) Ac eithrio pan fydd paragraffau (2) a (4) yn gymwys, £1,000 yw swm y gosb y mae awdurdod gwaredu gwastraff yn agored i'w dalu o dan adran 12(3) o'r Ddeddf.
(2) Pan fydd awdurdod gwaredu gwastraff —
(i)yn tanddatgan faint o wastraff trefol a gasglwyd neu faint o wastraff trefol a anfonwyd i safleoedd tirlenwi; neu
(ii)yn gorddatgan faint o wastraff trefol a ddargyfeiriwyd i gyfleusterau gwastraff eraill,
£200 fesul tunnell o'r gwall yw'r gosb y mae awdurdod gwaredu gwastraff yn agored i'w thalu o dan adran 12(3) o'r Ddeddf.
(3) At ddibenion paragraff (2), “y gwall” yw faint y mae swm gwirioneddol y gwastraff trefol pydradwy a anfonwyd i safle tirlenwi gan yr awdurdod gwaredu gwastraff yn y flwyddyn gynllun yn fwy na swm y gwastraff trefol pydradwy a fyddai wedi'i anfon i safle tirlenwi am y flwyddyn honno petai'r ffigurau a ddatganwyd gan yr awdurdod wedi bod yn gywir.
(4) Pan fydd awdurdod gwaredu gwastraff yn methu â chyflwyno unrhyw ddychweliad ynglŷn â blwyddyn gynllun yn unol â rheoliad 6(4), mae'r awdurdod hwnnw yn agored i gosb sy'n gyfartal â £400 am bob tunnell o'r lwfans cyfan a ddyrannwyd i'r awdurdod hwnnw ar gyfer y flwyddyn honno a'r ffigur hwnnw.
