The Scarweather Sands Offshore Wind Farm Order 2004

Coming into force

WHEREAS an application has been made to the National Assembly for Wales (“the National Assembly”), in accordance with the Transport and Works (Applications and Objections Procedure) (England and Wales) Rules 20001 made under sections 6, 6A, 7 and 10 of the Transport and Works Act 19922 (“the 1992 Act”), for an Order under section 3 of the 1992 Act;

AND whereas the National Assembly has caused an inquiry to be held for the purposes of the application pursuant to section 11 of the 1992 Act;

AND whereas the National Assembly, having considered the report of the person who held the inquiry, has determined to make an Order giving effect to the proposals comprised in the application with modifications which in its opinion do not make any substantial change to the proposals;

AND whereas notice of the National Assembly’s determination was published in the London Gazette on 2 November 2004;

NOW THEREFORE, the National Assembly, in exercise of the powers conferred on the Secretary of State by sections 3 and 5 of, and paragraphs 1 to 5, 7, 8, 10, 11 and 15 to 17 of Schedule 1 to, the 1992 Act, and which are now exercisable by the National Assembly3, and of all other powers enabling it in that behalf, hereby makes the following Order:
