Cyfyngu ar gyhoeddi etc. deunydd hyrwyddo

5.—(1) Mae'r rheoliad hwn yn gymwys i unrhyw ddeunydd sydd —

(a)yn darparu gwybodaeth gyffredinol am y refferendwm;

(b)yn ymwneud ag unrhyw un o'r materion a godir gan y cwestiwn i'w ofyn yn y referendwm; neu

(c)yn cyflwyno unrhyw ddadleuon o blaid neu yn erbyn ateb penodol i'r cwestiwn hwnnw.

(2) Yn ddarostyngedig i baragraff (3), ni chaiff neb gyhoeddi unrhyw ddeunydd y mae'r rheoliad hwn yn bethnasol iddo gan neu ar ran awdurdod lleol yn ystod y cyfnod o 28 diwrnod sy'n dod i ben ar ddyddiad y bleidlais yn y refferendwm.

(3) Nid yw paragraff (2) yn gymwys i —

(a)ddeunydd a drefnwyd iddo fod ar gael i bersonau mewn ymateb i geisiadau arbennig am wybodaeth neu i bersonau sy'n cael mynd ati yn benodol;

(b)cyhoeddi gwybodaeth sy'n perthyn i gynnal y bleidlais yn y refferendwm; neu

(c)cyhoeddi datganiadau i'r wasg ac sy'n cynnwys gwybodaeth ffeithiol os unig ddiben y cyhoeddi yw gwadu neu gywiro unrhyw anghywirdeb mewn deunydd a gyhoeddir gan berson ar wahân i'r awdurdod lleol.

(4) Yn y rheoliad hwn bydd “cyhoeddi” yn golygu darparu i'r cyhoedd yn gyffredinol, neu i unrhyw ran o'r cyhoedd, ar ba bynnag ffurf a thrwy ba bynnag ddull (gan gynnwys, yn arbennig felly, drwy gynhwysiad mewn unrhyw raglen a gynhwysir mewn gwasanaeth rhaglenedig yn unol â ystyr Deddf Ddarlledu 1990(1)); ac fe ddeellir “cyhoeddiad” yn yr un modd.
