Mae'n rhaid i bob person sy'n rhoi gofal dydd i blant sy'n iau nag wyth mlwydd oed gofrestru o dan Ran XA o Ddeddf Plant 1989. Effaith y Rheoliadau hyn fydd ei gwneud yn ofynnol i bob ysgol a oedd gynt yn esempt o'r rheidrwydd cofrestru hwn i wneud felly os prif bwrpas y gofal dydd yw gofalu am blant, a hynny ag eithrio wrth roi addysg iddynt.
Rhaid i ysgolion sydd yn rhoi gofal dydd am y tro cyntaf ar 31 Ionawr 2005 neu ar ôl hynny fod wedi'u cofrestru'n ddarparwyr gofal dydd cyn iddynt agor ar gyfer busnes.
O ran ysgolion a oedd yn darparu gofal dydd cyn 31 Ionawr 2005 ac a fydd yn parhau i wneud hynny ar ôl y dyddiad hwnnw, mae'r Rheoliadau yn gwneud darpariaethau trosiannol. O dan y darpariaethau trosiannol hyn, caiff ysgolion felly barhau i ddarparu gofal o'r fath hyd at 1 Ebrill 2005 ac, os ydynt yn gwneud cais i gofrestru cyn y dyddiad hwnnw, cânt barhau i wneud hynny ar ôl y dyddiad hwnnw hyd nes y bydd y cais wedi ei benderfynu, neu, os gwneir apêl yn erbyn y penderfyniad, hyd nes y bydd yr apêl wedi ei benderfynu neu wedi ei ollwng. Bydd ysgolion sy'n methu â gwneud cais o'r fath cyn 1 Ebrill 2005 yn cyflawni tramgwydd o dan adran 79D(5) o'r Ddeddf os byddant yn parhau i ddarparu gofal dydd ar ôl y dyddiad hwnnw.
