Diwygio trefniadau'r AGB heb bleidlais ddiwygio
16.—(1) Yn ddarostyngedig i baragraffau (2) i (4), caniateir diwygio trefniadau'r AGB heb bleidlais ddiwygio pan fydd y trefniadau yn cynnwys darpariaeth i alluogi gwneud hynny.
(2) Ni chaiff unrhyw ddarpariaeth ym mharagraff (1) ddiwygio —
(a)ardal ddaearyddol yr AGB; na
(b)lefi'r AGB mewn ffordd a fyddai yn —
(i)achosi unrhyw berson i fod yn atebol i dalu lefi'r AGB lle nad oedd yn atebol i'w thalu'n flaenorol; na
(ii)chynyddu lefi'r AGB i unrhyw berson.
(3) Pan fydd paragraff (1) yn berthnasol, rhaid i drefniadau'r AGB gynnwys darpariaeth yn disgrifio'r weithdrefn sydd i'w dilyn ar gyfer gwneud y diwygiad.
(4) Rhaid i'r weithdrefn y cyfeirir ati ym mharagraff (3) gynnwys —
(a)lle ceir corff AGB, ymgynghoriad rhwng y corff AGB a'r awdurdod bilio perthnasol; a
(b)lle mai'r corff AGB awdurdod lleol sy'n gyfrifol am weithredu trefniadau'r AGB, rhaid cynnal ymgynghoriad rhwng yr awdurdod bilio perthnasol ac unrhyw gynrychiolwyr o'r gymuned fusnes yn ardal ddaearyddol yr AGB y gwêl yr awdurdod yn briodol.
(5) Pan fydd trefniadau'r AGB yn cael eu diwygio o dan y rheoliad hwn —
(a)rhaid i'r awdurdod bilio perthnasol sicrhau bod trefniadau'r AGB (wedi eu diwygio) wedi eu gwneud erbyn yr amser y mae'n rhaid i'r trefniadau AGB hynny (wedi eu diwygio) ddod i rym a rhaid iddo anfon hysbysiad yn egluro'r rheswm dros y diwygiad a'i effaith at bob person sy'n atebol i dalu lefi'r AGB; a
(b)bydd adrannau 44 hyd at 47 y Ddeddf, rheoliadau 14 i 18 ac Atodlenni 3 a 4 yn effeithiol o'r dyddiad y daw trefniadau'r AGB (wedi eu diwygio) i rym fel pe bai cyfeiriad ym mhob un o'r darpariaethau hyn at “drefniadau'r AGB” yn gyfeiriad at drefniadau'r AGB (wedi eu diwygio).
