Cydsyniad y gwrthrych â datgeliad etc
12.—(1) Rhaid i asiantaeth beidio â datgelu unrhyw wybodaeth adnabod am y gwrthrych i'r person sy'n gofyn am yr wybodaeth honno heb sicrhau cydsyniad y gwrthrych.
(2) Rhaid i'r asiantaeth gymryd pob cam rhesymol i sicrhau bod gan y gwrthrych ddigon o wybodaeth i'w alluogi i wneud penderfyniad deallus ynghylch a ddylai gydsynio ag unrhyw ddatgeliad o'r fath.
(3) Os yw'r gwrthrych wedi marw neu os bydd yr asiantaeth yn penderfynu ei fod yn analluog i gydsynio, caiff yr asiantaeth ddatgelu'r wybodaeth adnabod am y gwrthrych sy'n briodol o ystyried lles y rhai y gallai'r datgeliad effeithio ar eu lles a chaniateir i'r broses hon gynnwys dod o hyd i farn y personau hynny.
(4) Yn y rheoliad hwn ac yn rheoliad 14, ystyr “gwybodaeth adnabod” yw gwybodaeth a fyddai'n galluogi o'i chymryd ar ei phen ei hun neu ynghyd â gwybodaeth arall a feddir gan y person sy'n gofyn amdani, i'r gwrthrych gael ei adnabod a'i olrhain.
