Gweithfeydd gwyro a wneir gan awdurdod oherwydd gweithfeydd pwysig yr awdurdod
4.—(1) Lle mae'r awdurdod yn gwneud gweithfeydd gwyro, oherwydd gweithfeydd pwysig a gychwynnir gan awdurdod, rhaid i'r ymgymerwr, yn ddarostyngedig i baragraff (2), dalu i'r awdurdod —
(a)lle mae'r gweithfeydd pwysig yn weithfeydd trafnidiaeth pwysig heblaw'r rhai —
(i)sydd hefyd yn weithfeydd pontydd pwysig, neu
(ii)sy'n weithfeydd adran 86(3) (a) i (g),
swm sy'n gyfartal i 7.5 y cant o gostau a ganiateir y gweithfeydd gwyro;
(b)ym mhob achos arall, swm sy'n gyfartal i 18 y cant o gostau a ganiateir y gweithfeydd gwyro.
(2) Lle y symudir cyfarpar ymgymerwr gan yr awdurdod ar gais yr ymgymerwr a hynny yn unig oherwydd newid yn y math o adeiladu ar gyfer priffyrdd, nad yw'n golygu newid yn nyfnder y gorchudd i ddyfnder sy'n llai neu'n fwy na'r dyfnder derbyniol a grybwyllir yn Atodiad B i'r Cod, rhaid i'r ymgymerwr dalu i'r awdurdod y costau a ganiateir a dynnir gan yr awdurdod wrth symud y cyfarpar.
(3) Mae'r rheoliad hwn yn ddarostyngedig i reoliad 6.
