Tramgwyddau gan gyrff corfforaethol neu bartneriaethau yn yr Alban
36.—(1) Os profir bod tramgwydd o dan y Rheoliadau hyn a gyflawnwyd gan gorff corfforaethol wedi'i gyflawni gyda chaniatâd neu gydymddygiad y canlynol neu y gellir ei briodoli i esgeulustod ar ran y canlynol—
(a)unrhyw gyfarwyddwr, rheolwr, ysgrifennydd neu swyddog tebyg o'r corff corfforaethol; neu
(b)unrhyw berson a oedd yn honni bod yn gweithredu yn rhinwedd y cyfryw swydd,
tybir y bydd y person hwnnw yn ogystal â'r corff corfforaethol yn euog o'r tramgwydd hwnnw ac yn agored i gael ei erlyn a'i gosbi yn unol â hynny.
(2) Ym mharagraff (1) ystyr “cyfarwyddwr” mewn perthynas ag unrhyw gorff corfforaethol a sefydlwyd gan neu o dan unrhyw ddeddfiad er mwyn cyflawni unrhyw ymgymeriad o dan berchenogaeth genedlaethol, sef corff corfforaethol y rheolir ei faterion gan ei aelodau, yw aelod o'r corff corfforaethol hwnnw.
(3) Os profir bod tramgwydd o dan y Rheoliadau hyn a gyflawnwyd gan bartneriaeth o'r Alban wedi'i gyflawni gyda chaniatâd neu gydgynllwyn partner neu y gellir ei briodoli i unrhyw esgeulustod ar ran partner, tybir bod y partner hwnnw yn ogystal â'r bartneriaeth yn euog o'r tramgwydd hwnnw ac yn agored i reithdrefnau gael eu dwyn yn eu herbyn neu eu cosbi yn unol â hynny.
