Disapplication of Science at Key Stage 4E+W

3.—(1) Subject to regulation 4, the requirements of the National Curriculum for Wales for science at the fourth key stage are not to apply to a pupil at a maintained school at any time when the head teacher of the school is satisfied that the pupil is pursuing a course leading to the award of a relevant science qualification.

(2) For the purposes of paragraph (1), a qualification is a relevant science qualification if–

(a)it is, at the material time, approved under section 99 of the Learning and Skills Act 2000(1), for the purposes of section 96(2)(b) of that Act, as an external qualification the course leading to which may be provided by or on behalf of a maintained school, and

(b)the qualification is a qualification in science in the NQF at Entry level, level 1 or level 2.
