Pasbortau planhigion
8.—(1) Mae erthyglau canlynol y prif Orchymyn yn gymwys o ran pasbortau planhigion sy'n ofynnol o dan erthyglau 5 neu 6, fel sy'n briodol, o'r Gorchymyn hwn—
(a)erthygl 11(3), fel pe bai —
(i)tystysgrif ffytoiechydol wedi'i dyroddi o ran deunydd sy'n dueddol o gael y pla ac a oedd yn cydymffurfio â'r Gorchymyn hwn; a
(ii)cyfeiriad at “Ran A o Atodlen 5”o'r prif Orchymyn yn gyfeiriad at erthygl 5 o'r Gorchymyn hwn;
(b)erthygl 14(1), fel pe bai'r pasbort planhigion wedi'i ddyroddi o ran deunydd sy'n dueddol o gael y pla; ac
(c)erthygl 14(2) i (8).
(2) Yn ddarostyngedig i baragraff (4), mae person sydd wedi'i awdurdodi gan y Cynulliad Cenedlaethol o dan erthygl 17 o'r prif Orchymyn i gynhyrchu, storio a dyroddi pasbortau planhigion ar ran busnes hefyd wedi'i awdurdodi o dan y Gorchymyn hwn i gynhyrchu, storio a dyroddi pasbortau planhigion sy'n ofynnol o dan y Gorchymyn hwn ar ran y busnes hwnnw.
(3) Caiff y Cynulliad Cenedlaethol, yn ddarostyngedig i unrhyw amodau y gwêl yn dda eu gosod, awdurdodi person nas awdurdodwyd o dan baragraff (2), i gynhyrchu, storio a dyroddi pasbortau planhigion sy'n ofynnol o dan y Gorchymyn hwn ar ran unrhyw fusnes, unigolyn neu gorff arall,—
(a)os yw'r person sy'n gofyn am gael ei awdurdodi wedi'i gofrestru'n gynhyrchydd deunydd sy'n dueddol o gael y pla o dan erthygl 7; a
(b)os bod arolygiad boddhaol wedi'i wneud gan arolygydd o fan cynhyrchu'r deunydd sy'n dueddol o gael y pla a bod hwnnw'n fan y ceisir awdurdod mewn cysylltiad ag ef, neu o unrhyw ran o'r fan, neu o unrhyw fangre arall sy'n trafod unrhyw ddeunydd sy'n dueddol o gael y pla, a hynny at ddibenion canfod, o ran Phytophthora ramorum , statws iechyd planhigion y deunydd sy'n dueddol o gael y pla, yn y lle hwnnw neu'r fangre honno, ac unrhyw blanhigion neu gynhyrchion planhigion sydd yno.
(4) Caiff arolygydd dynnu'n ôl awdurdod a roddir i berson o dan baragraff (2) neu (3) i gynhyrchu, storio a dyroddi pasbortau planhigion sy'n ofynnol o dan y Gorchymyn hwn os yw'r arolygydd wedi'i fodloni nad yw'r person hwnnw'n bodloni darpariaethau'r Gorchymyn hwn o ran pasbortau planhigion.
