The Welsh Ministers, in exercise of the powers conferred on the National Assembly for Wales by sections 132, 134, 135, 145(1) and (2) and 210(7) of the Education Act 2002 and now vested in them M1 and in exercise of the powers conferred on the Secretary of State by sections 19 and 42(6) and (7) of the Teaching and Higher Education Act 1998 and now vested in them M2 make the following Order:

M12002 c. 32. The functions of the National Assembly for Wales under these sections were transferred to the Welsh Ministers under paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).

M21998 c. 30. The functions of the Secretary of State under these sections were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and then to the Welsh Ministers under paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).

Name, commencement and applicationE+W

1.—(1) The title of these Regulations is the Education (Amendments to Regulations regarding the Recognition of Professional Qualifications) (Wales) Regulations 2007 and come into force on 20 October 2007.

(2) These Regulations apply in relation to Wales.

Amendment to the Education (School Teachers' Qualifications) (Wales) Regulations 2004E+W

2.  In paragraph 4 of Schedule 2 to the Education (School Teacher's Qualifications) (Wales) Regulations 2004 M3 for the words “Article 3 of Council Directive 89/48 EEC on a general system for the recognition of higher-education diplomas awarded on completion of professional education and training of at least three years' duration” substitute “ the European Communities (Recognition of Professional Qualifications) Regulations 2007 ”.

4.  In regulation 2 of the Head Teachers' Qualifications and Registration (Wales) Regulations 2005 M4 in the definition of “the 2005 Regulations” for the words “the European Communities (Recognition of Professional Qualifications) (First General System) Regulations 2005” substitute “ The European Communities (Recognition of Professional Qualifications) Regulations 2007 ”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which apply in relation to Wales, substitute for references to Council Directive 89/48/EEC in the Education (School Teachers' Qualifications) (Wales) Regulations 2004 and the Education (Induction Arrangements for School Teachers) (Wales) Regulations 2005 references to the European Communities (Recognition of Professional Qualifications) Regulations 2007 (“the Regulations”). The Regulations implement Council Directive 2005/36/EC on the recognition of professional qualifications and replaces the previous Council Directive relating to the first, second and third General Systems on the mutual recognition of professional qualifications.

These Regulations also substitute for reference in the Head Teachers' Qualifications and Registration (Wales) Regulations 2005 to the European Communities (Recognition of Professional Qualifications) (First General System) Regulations 2005 reference to The European Communities (Recognition of Professional Qualifications) Regulations 2005.
