Troseddau gan gyrff corfforaethol neu bartneriaethau Albanaidd
15.—(1) Pan brofir bod trosedd o dan y Rheoliadau hyn, a gyflawnwyd gan gorff corfforaethol, wedi ei chyflawni gyda chydsyniad neu gydgynllwyn unrhyw un o'r canlynol, neu ei bod i'w phriodoli i unrhyw esgeulustod ar ran unrhyw un o'r canlynol, sef —
(a)unrhyw gyfarwyddwr, rheolwr, ysgrifennydd neu swyddog cyffelyb arall o'r corff corfforaethol, neu
(b)unrhyw berson a oedd yn honni ei fod yn gweithredu mewn cymhwyster o'r fath,
ystyrir bod y person hwnnw yn ogystal â'r corff corfforaethol yn euog o'r drosedd honno ac yn agored i fod yn destun achos cyfreithiol ac i gael ei gosbi yn unol â hynny.
(2) Pan brofir bod trosedd o dan y Rheoliadau hyn, a gyflawnwyd gan bartneriaeth Albanaidd, wedi ei chyflawni gyda chydsyniad neu gydgynllwyn partner, neu ei bod i'w phriodoli i unrhyw esgeulustod ar ran partner, ystyrir bod y person hwnnw yn ogystal â'r bartneriaeth yn euog o'r drosedd honno ac yn agored i fod yn destun achos cyfreithiol ac i gael ei gosbi yn unol â hynny.
