The Welsh Ministers, in exercise of the powers conferred on the Secretary of State by sections 75 and 104(1) of the New Roads and Street Works Act 1991(1), and now vested in them(2), make the following regulations:

Title, commencement and application

1.  The title of these Regulations is the Street Works (Inspection Fees) (Wales) (Amendment) (No. 2) Regulations 2008. They come into force on 22 May 2008 and apply in relation to Wales.

Amendment to the Street Works (Inspection Fees) (Wales) Regulations 2006

2.  The Street Works (Inspection Fees) (Wales) Regulations 2006, as amended(3) are further amended in accordance with regulation 3.

3.  In regulation 3, in paragraphs (1) and (8), for “£24.00” substitute “£25.00”.

Revocation of the Street Works (Inspection Fees) (Wales) (Amendment) Regulations 2008

4.  The Street Works (Inspection Fees) (Wales) (Amendment) Regulations 2008 (4) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations revoke and replace the Street Works (Inspection Fees) (Wales) (Amendment) Regulations 2008 (“the 2008 Regulations”). The 2008 Regulations further amend the Street Works (Inspection Fees) (Wales) Regulations 2006 (“the 2006 Regulations”) so as to increase the fee payable by undertakers for inspections of their work by street authorities in Wales, under regulation 3 of the 2006 Regulations.

The fee originally prescribed in the 2006 Regulations was £21. The fee was altered to £24 in July 2007 by the Street Works (Inspection Fees) (Wales) (Amendment) Regulations 2007 (S.I. 2007 No.1713 (W.150)), and is now increased to £25.

The functions of the Secretary of State under sections 75 and 104(1) were transferred, so far as exercisable in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), article 2 and Schedule 1. Section 75 is prospectively substituted by section 58(2) of the Traffic Management Act 2004 (c. 18). The functions of the National Assembly for Wales under the said sections 75 and 104(1) were transferred to the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
