Y safon ofynnol mewn perthynas â deunyddiau ac eitemau amlhaenog plastig

11.—(1) Yn ddarostyngedig i baragraff (2), mae deunydd neu eitem amlhaenog plastig yn bodloni'r safon ofynnol os yw pob haen y mae wedi ei gyfansoddi ohoni'n cydymffurfio â'r Rheoliadau hyn.

(2) Nid oes rhaid i haen nad yw mewn cyffyrddiad uniongyrchol â bwyd ac sydd wedi ei gwahanu oddi wrth gyffyrddiad o'r fath gan wahanfur swyddogaethol plastig gydymffurfio â gofynion y Rheoliadau hyn ar yr amod —

(a)bod y deunydd neu'r eitem gorffenedig yn cydymffurfio â'r terfynau ymfudiad perthnasol yn benodol ac yn gyflawn; a

(b)os nad yw unrhyw sylwedd a ddefnyddir wrth weithgynhyrchu'r haen yn cael ei gynnwys yn y Gyfarwyddeb neu mewn rhestrau cenedlaethol y cyfeirir atynt yn y Gyfarwyddeb honno, bod y sylwedd hwnnw'n bodloni gofynion paragraffau (3) a (4).

(3) Rhaid i sylwedd a grybwyllir ym mharagraff (2)(b) beidio â bod yn perthyn i gategori'r rhai a ddosberthir—

(a)yn sylweddau y profwyd neu yr amheuir eu bod yn sylweddau carsinogenaidd, mwtagenaidd neu wenwynig i atgenhedlu yn Atodiad I i Gyfarwyddeb 67/548/EEC(1), neu

(b)o dan y meini prawf hunangyfrifoldeb yn sylweddau carsinogenaidd, mwtagenaidd neu wenwynig i atgenhedlu yn unol â rheolau Atodiad VI i'r Gyfarwyddeb honno.

(4) Rhaid i ymfudiad sylwedd a grybwyllir ym mharagraff (2)(b) i fwyd neu efelychyn bwyd beidio â bod yn fwy na 0.01 mg/kg, wedi ei fesur a'i fynegi yn unol â'r gofynion a'r manylebau a geir yn Erthygl 7a(3) o'r Gyfarwyddeb.
